Copyright Policy (DMCA)

1. Overview. Franchise Hub respects copyright and expects users to do the same. This page explains how to report copyright infringement on Franchise Hub under the Digital Millennium Copyright Act (17 U.S.C. § 512), and what happens after a report.

2. How to send an infringement notice. If you believe content on Franchise Hub infringes your copyright, send a written notice to our designated agent (clause 3) that includes all of the following:

1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
2. Identification of the copyrighted work you claim has been infringed (or, if multiple works are covered by one notice, a representative list of them).
3. Identification of the material you claim is infringing, with enough information for us to find it — for example, the page URL, Discord server, channel, or message link where it appears.
4. Your contact information: name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Notices missing any of these elements may not be effective under the DMCA, and we may ask you to resubmit.

4. What we do. When we receive a valid notice, we will remove or disable access to the identified material, make a reasonable effort to notify the user who posted it, and keep a record of the notice.

5. Counter-notice. If your material was removed and you believe it was removed by mistake or misidentification, you may send our designated agent a written counter-notice that includes: your physical or electronic signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, any judicial district in which Franchise Hub may be found) and that you will accept service of process from the person who filed the original notice or their agent. If we receive a valid counter-notice, we will forward it to the original complainant and may restore the material in 10 to 14 business days unless the complainant tells us they have filed a court action seeking to restrain the alleged infringement.

6. Repeat infringers. Accounts of users who repeatedly infringe copyright will be terminated in appropriate circumstances.

7. Misrepresentation. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.
